Introduction

We know that you care about your personal data and how it is used, and we want you to trust that Protix uses your personal data carefully. This privacy & cookie statement (hereafter: “Privacy & Cookie Statement”) will help you understand what personal data we collect, why we collect it and what we do with it.

This Privacy & Cookie Statement applies to all Protix companies, including its affiliates (being Protix B.V., Protix Ingredients B.V., Fair Insects B.V., Protix US Holding Company LLC and Protix Poland sp. z o. o. (hereafter: “Protix” or “we”).

In this Privacy & Cookie Statement, we describe the practices we follow to respect your privacy. The most recent version of this Privacy & Cookie Statement can be found on the website of Protix and can be downloaded, printed and saved to your computer.

When is this Privacy & Cookie Statement applicable?

This Privacy & Cookie Statement is applicable to all personal data that is being collected and processed by Protix in connection with the services and products we offer through our website applications and other online platforms, by phone, via emails or other offline methods. By using our websites and our services, you also are consenting to our use of your personal data (including cookies) in accordance with this Privacy & Cookie Statement.

If you provide us with personal data relating to other persons (such as work colleagues, employees, etc.), you are responsible for ensuring the relevant individuals are made aware of the terms of this Privacy & Cookie Statement and that you are legally entitled to provide us with their personal data. You are also responsible for ensuring that their personal data is accurate and up-to-date.

What kind of personal data will be processed?

Personal data is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a natural person.

The personal data that we process includes but is not limited to:

  • your name (including name prefix or title), the company you work for and the market(s) your company is active, your title or position, your IP address, postal address, email address and phone number(s);

  • device data, your internet behaviour and other information from your visits to our website or in relation to communications we send to you electronically;

  • information you provide to us for the purposes of newsletter requests and attending meetings and events, including access and dietary requirements;

  • job applicant data, identification and background information (including your resume) provided by you or collected as part of our business acceptance processes; and

  • any other information relating to you which you may provide to us.

We may collect personal data from different types of sources. This includes: personal data you give us directly, personal data we collect automatically, and personal data we collect from other sources.

Why do we process this personal data?

Protix will use this personal data for specific and limited purposes. For example:

  • making the Protix website and mailings (including invites for special events) available to its users and to recognise you when you return to our website;

  • making available to you and providing you or your employer with the services and products;

  • handling and responding to your inquiries or to reach out to you to address your questions and/or requests;

  • internal training and quality assurance purposes;

  • understanding and assessing the interests, wants, and changing needs of customers and consumers, to improve our website, our current products and services, and/or developing new products and services;

  • we create profiles by analysing the information about your online surfing, searching and buying behaviour and your interactions with our brand communications by building segments (creating groups that have certain common characteristics) and by placing your personal data in one or more segments. We do this to provide personalised products, communications and targeted advertising as well as product recommendations to you; and

  • optimizing Protix’ services, whether provided via the Protix website or otherwise.

Protix processes your personal data therefore on the basis of your consent, preparing or carrying out an agreement with you, the legitimate interest of Protix or a legal obligation that we have.

  • We will request your permission to process the personal data if and when it is relevant. When you have agreed to processing activities, you can revoke your agreement any time you want.

  • We process your personal data to carry out a contract that you are or will be involved in. For example, we need to process your personal data to deliver a product or a service that you purchased or to send you samples that you asked for.

  • We also use Protix’s legitimate interest as the basis for processing your personal data. For example, for our marketing, market research and business development. This ground will only be used where it is necessary and does not outweigh your rights as an individual.

  • We also process your personal data when we have to do so by law (e.g., for tax purposes or social security obligations).

Do we process any special and/or sensitive personal data?

Our website and/or services do not intend to collect special and/or sensitive personal data or data on website visitors who are under 16 years of age. Unless they have permission from parents or guardian. However, we cannot verify whether a visitor is older than 16 years old. Therefore, we encourage parents to be involved in their children's online activities in order to avoid collecting information about children without parental consent. If you believe that we have collected personal information about a minor without such consent, please contact us and we will delete this information as soon as possible.

With whom do we share your personal data?

Your personal data will be shared within the Protix group and with selected third-parties for purposes described in this Privacy & Cookie Statement. In order to carry out your requests, respond to your inquiries, fulfil your orders, provide you with samples, or make various other services and materials available to you (through our websites or otherwise) we share your personal data with third-party service providers that perform functions on our behalf, such as companies that: host or operate Protix’s websites, process payments, analyse data, integrate (CRM) systems, provide customer service, postal or transport services. They have access to personal data needed to perform their functions but may not use it for other purposes. Further, they must process this personal data in accordance with applicable data protection laws and regulations.

Other third-parties. Your personal data will also be used by us or shared with our advertising networks, advertising servers, social media networks, and analytics companies or other third-parties in connection with our customer targeting.

The nature of the internet in general and of the Protix website in particular means that your personal data might also be used outside of the European Union. To enable us to make available to you and provide you with the services referred to in this Privacy & Cookie Statement, you will consent to the use of the personal data gathered on the Protix website and referred to in this Privacy & Cookie Statement in countries outside of the European Union, and, where necessary, to the exchange of such data with other firms and/or service providers engaged by Protix.  Protix will only send personal data collected within the European Economic Area (EEA) to foreign countries in circumstances such as:

  • To follow your instructions;

  • To comply with a legal duty; or

  • To work with our agents and advisers who we use to help run our business and services.

If we do transfer personal data to outside of the EEA, Protix will make sure that it is protected in the same way as if it was being used in the EEA. We’ll use one of the following safeguards:

  • Transfer to a non-EEA Country whose privacy legislation ensures an adequate level of protection of personal data to the EEA one;

  • Put in place a contract with the foreign third-party that means they must protect personal data to the same standards as the EEA; or

  • Transfer personal data to organisations that are part of specific agreements on cross-border data transfers with the European Union (e.g., Privacy Shield, a framework that sets privacy standards for data sent between the United States and the European countries, or similar frameworks).

What are cookies?

A ‘cookie’ is a small unit of information which can be passed to your browser while you are on the Protix website. In some cases, Protix uses cookies to ensure that use of the Protix website is as efficient as possible. If you do not want Protix to use cookies with your browser, the settings on your browser can be changed so that the cookies are deactivated. If you do not allow the use of cookies and have deactivated the cookies or arranged to have the cookies deactivated, this may have consequences for the ease of use of the Protix website.

How do we use cookies?

We and some third parties put cookies on our Protix website, to run the website and services, learn how you use the website to improve your experience, and understand how you use the website to make our website, products, and services better.

We use the following categories of cookies on our website:

  • Necessary cookies: These cookies are required for the website to operate and cannot be turned off. You can configure your browser to reject or notify you about these cookies, but some portions of the site will then not function.

  • Functional Cookies: These cookies make the website work better and help create a more personalized experience. They can come from us or from other third party providers whose services we use on our pages. If you block these cookies, some or all of these services might not work properly.

  • Performance Cookies: These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our site. They help us to know which pages are the most and least popular and see how visitors move around on the website.

  • Marketing Cookies: These cookies may be set through our site by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant adverts on other sites. During some of your internet browsing we may also use software tools to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information, and methods used to browse away from the page. These may include cookies from social media. These cookies are set by a range of social media services that we have added to the site to enable you to share our content with your network. They are capable of tracking your browser across other sites and building up a profile of your interests. These sharing tools may not work or be visible if you disable these cookies. The buttons work because of pieces of code that come from the social media networks. Protix has no influence on this. Protix will not be responsible for the content of these websites or the actions of these third parties and other parties present on these websites. We will ask for your consent to use any cookies that are not essential when you access our website. You can use the consent management tool we offer to control your options. You can always opt out again by using the manage cookies link at the bottom of our website.

Why do we use cookies?

The Protix website automatically generates log files that register the use by you and other users of the Protix website. Protix maintains user data, such as source addresses of pages requested, IP (internet protocol) addresses and domain names, dates and times of page requests, links from other websites and other parameters in the URLs (universal resource locators). These log files and data will be used, on an anonymous basis, for statistical purposes and for improving the services offered via the Protix website.

How do I delete cookies?

Cookies are placed on your own device. This means that we cannot delete them for you. You must do so yourself in the manner prescribed for your specific device.

Google Analytics and Advertising

We use Google Analytics to better understand how our users interact with us. Our ability to use and share information collected by Google Analytics about your visits to our sites is restricted by the Google Analytics Terms of Use (https://marketingplatform.google.com/about/analytics/terms/us/) and the Google Privacy Policy (https://policies.google.com/privacy). Applying for a job at Protix?

Have you responded to one of our vacancies or submitted an open application? If so, we will process your personal data in order to process your application.

For this purpose, we process personal data including your curriculum vitae, motivation letter, salary indication, references and any other information you enclose with your application

We need this information in order to go through the job application process and to assess whether we are a good fit. If we do not hire you, we will store your application details for a maximum of six weeks after the position has been filled.  This way, we can still approach you for future opportunities. If we are unable to offer you a job at this time, we may – with your permission – keep your application details for a further year. You can withdraw your consent at any time by sending us an email. If you come to work for us, we will save your application data in the personnel file. 

We may perform a social media and internet check. We need to do this to preserve our reputation when we recruit new employees. We do this on the basis of our legitimate interest. For this purpose, we search your name on Google and, if necessary, your profile(s) on social media. We won't request access to a private social media page or ask you to connect with us and we do not reject people just because of screening results. If you object to this, you can indicate this by e-mail at the time of your application.

We may share your data with outside HR consultants and head-hunters who help us with our recruitment process.

How long do we retain personal data?

Protix will not retain your personal data longer than is necessary for the purposes described above, unless this data is necessary for complying with a legal retention obligation. Protix is subject to several legal retention obligations, for example but not limited to legal retention obligations based the Dutch Civil Code.

How do we make sure the data is secure?

Protix has put appropriate technical and organizational measures in place in order to safeguard your personal data against loss or any form of unlawful use. Those persons who, on behalf of Protix, have access to your personal data on a need-to-know basis, have a confidentiality obligation – including that prescribed by the applicable code of conduct and professional practice. If you feel that your information is not properly safeguarded or there are indications of misuse, please contact our customer service team.

What are your rights?

You have the right to view, correct, or delete your personal data. You can also withdraw any consent you may have given for the processing of your data or object to the processing of your personal data by Protix and you have the right to have personal data relating to your transferred to you in a computer file or to another organization. You can send a request for inspection, correction, deletion, data transfer of your personal data or a request to withdraw your consent or objection to the processing of your personal data to info@protix.com. To ensure that the request for inspection has been made by you, we ask you to send a copy of your identity document with your request. Black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and BSN (citizen service number) in this copy. This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.

With regard to a request to erase personal data, it should be taken into account that Protix shall not comply with such request, if it is incompatible with any legal retention obligations of Protix.

Changes to this Privacy & Cookie Statement

Protix may change this Privacy & Cookie Statement as needed without prior notice. If changes to the Privacy & Cookie Statement are made, please note that it may take up to 30 business days before new privacy practices are implemented. Check this page periodically if you would like to monitor changes.
